Terms of Service
These Terms of Service ("Terms") govern your use of the Sleep Recorder mobile application ("App") on iOS. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Description of Service
Sleep Recorder is a mobile app that allows you to:
- Record sleep audio on your device.
- Process recordings on your device to extract high-decibel segments (e.g. snoring, sleep talking, teeth grinding) and view them with timestamps.
- Tag recordings with pre-sleep state and behavior type.
- View and play recordings and segments in Sleep Records, and see aggregated statistics in the Data Report.
- Set daily reminders (e.g. when to start or stop recording).
- Set a profile name and avatar if you choose.
All recording, processing, and storage is performed on your device. We do not operate servers that store or process your content.
2. Eligibility
You must be at least 13 years of age (or the applicable age of consent in your country) to use the App, or have your parent or guardian's permission. If you are a parent or guardian, you are responsible for the use of the App by minors under your care.
3. Acceptable Use
You agree to use the App only for lawful purposes. You must not:
- Use the App to capture, store, or share content that is illegal, harmful, abusive, defamatory, or that infringes others' rights.
- Use the App to harass, bully, or harm others.
- Attempt to reverse-engineer, decompile, or extract the App's source code, except as allowed by applicable law.
- Use automated means to access or use the App in ways we did not intend.
We may suspend or terminate your access to the App if we believe you have violated these Terms or applicable law.
4. No Account or Login
Sleep Recorder does not require you to create an account or log in. All data is stored locally on your device. You are responsible for keeping your device secure and for any use of the App on your device.
5. Subscriptions and Purchases
The App may display information about subscription plans. When in-app purchases are available, additional terms and Apple's terms will apply. Payment processing is handled by Apple. We do not store your payment details.
6. Intellectual Property
Sleep Recorder, including the App's name, logo, design, and code, is owned by us or our licensors. You may not copy, modify, or distribute our intellectual property without our prior written consent. You retain ownership of the recordings and data you create; we do not claim ownership of your content.
7. Disclaimers
Not medical or professional advice. Sleep Recorder is a personal sleep recording and analysis tool. It is not a substitute for medical, sleep, or health advice. If you have or suspect a sleep or health condition (e.g. sleep apnea, chronic snoring), please consult a qualified healthcare professional. Do not rely on the App for diagnosis or treatment.
"As is" service. The App is provided "as is" and "as available". We do not guarantee that it will be error-free, secure, or uninterrupted. Use of the App is at your own risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App. Our total liability for any claims related to the App shall not exceed the amount you paid us in the twelve (12) months before the claim (or zero if you paid nothing). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless us and our affiliates from any claims, damages, losses, or expenses arising from your use of the App, your content, or your violation of these Terms or applicable law.
10. Changes to the App and These Terms
We may update the App or these Terms from time to time. We will indicate the "Last updated" date at the top. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.
11. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which we operate. Any dispute shall be resolved in the courts of that jurisdiction, except where prohibited by law.
12. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
